Zero-Tolerance Anti-Spam Policy

TriMark Capital Funding, Inc. is a No-Spam Zone. We maintain a strict zero-tolerance anti-Spam policy and enforce a zero-tolerance approach when dealing with Spam and all other types of unsolicited commercial bulk email and/or bulk electronic advertising.

What is Spamming?

TriMark Capital Funding, Inc. defines Spam as the sending of any type of unsolicited bulk commercial email or other electronic solicitation that does not comply with the CAN-SPAM Act of 2003, which includes or promotes the TriMark Capital Funding, Inc. business, business name, any of it's services, or any of it's trade names, trademarks, program names, website URL's or email addresses.

Sending or posting any unsolicited bulk commercial email or other electronic solicitation that does not comply with the CAN-SPAM Act of 2003, which includes or promotes the TriMark Capital Funding, Inc. business, business name, services, or any of it's trade names, trademarks, program names, website URL's or email addresses to:

• Anyone that has not requested this information from you first
• Any type of "Safe List" or through any type of "Safe List" service
• Any type of "lead" or "prospect" before you have received a request for more info from them
• Anyone as part of a confirmation/thank you letter as a result of a posting to a classified ad site or a FFA (Free For All Links) site
• Any chat room, newsgroup, bulletin board, or other public discussion forum

TriMark Capital Funding, Inc. employees, members, Locators, and affiliates are strictly prohibited and strongly discouraged from using Spam tactics in their marketing.

If you believe you have been Spammed and wish to make a formal complaint, please forward the complete email you received (without modification) to info@NoteBuyingBusiness.com so that we can read:

1. Your email address (TO ADDRESS) where you were Spammed
2. The email address (FROM ADDRESS) of our member who Spammed you
3. The body of the message (THE SOLICITATION)
4. Date you were Spammed

Anyone shown to be Spamming the TriMark Capital Funding, Inc. name or any of it's trade names, trademarks, programs, website URL's or email addresses will be subject to immediate, permanent suspension of membership (no membership refund will be issued) and forfeiture of all fees and commissions due. Offenders may also be subject to possible legal action including a $500 (US) charge per substantiated incident (i.e. per email) and will be reported to the Federal Trade Commission as required in the S.877 CAN-SPAM ACT. The CAN-SPAM Act of 2003 (Public Law 108-187) took effect January 1, 2004.

TriMark Capital Funding, Inc. recommends that you do not engage in any type of Spam tactics to promote your business. Provided you do not mention, promote, or make reference to the TriMark Capital Funding, Inc. name or any of it's trade names, trademarks, program names or any of it's website URL's or email addresses in any of your electronic marketing and you comply with the CAN-SPAM Act of 2003, you will not be in violation of this policy.

If you are pursuing some type of opt-in advertising, there is always a possibility that you will generate a complaint. Design your advertising in such a manner as to cause the prospect to request more information, and store all such requests in a permanent, secure location. With a valid information request, the Spam issue is not relevant, because you will be able to produce a copy of the specific request to refute any complaints that we might receive.

Auto responders are NOT Spam. They are based entirely around the opt-in model of email marketing. This means that your clients must first express interest in your business by sending you an email, filling out a form, or otherwise contacting you first. All Auto responder messages sent out by TriMark Capital Funding, Inc. have an Unsubscribe link and a Change Email Address link, so the client may opt-out of our list at any time, and we recommend that you employ a similar procedure if you choose to utilize an Auto responder.
